A 31-year-old Amman Valley man is set to fight a driving ban claiming he was the victim of drink-spiking.
Stewart Leonard Herbert, of 21 Banwen Place in Lower Brynaman, appeared before magistrates at Ammanford on March 3 to admit having 75 microgrammes of alcohol in 100 millilitres of breath when he was stopped by police in Garnant on February 13. The legal limit is 35 microgrammes.
However, Herbert has always maintained that the quantity of alcohol found in his system could only have come about if his drinks had been spiked.
Ammanford magistrates were this week told that expert witnesses called to analyse the results of Herbert’s tests had requested additional time to complete their work.
Herbert intends to urge magistrates to resist banning him from the road citing special reasons, namely he was unaware of the level of alcohol in his system.
Magistrates agreed to adjourn sentencing for the full results to be obtained.
Herbert will appear before Carmarthen magistrates on May 20 for a sentencing hearing.
